Options available when TAC benefits cease

If the TAC has denied or significantly reduced your benefits, you have three options moving forward:

If your benefits have been denied, you can request an informal review. This review is handled by a TAC Review Officer who is independent from the team that made the original decision.

While the review is free, it’s important to remember that since these officers are employed by the TAC, they may not always have your best interests at heart.

If you disagree with a TAC decision, there’s a formal dispute resolution process designed to resolve issues without going to court. It was developed by the TAC, the Law Institute of Victoria (LIV), and the Australian Lawyers Alliance (ALA) to make the process faster and less complex.

It’s important to know that you only have 12 months from the date of the TAC’s decision to lodge a dispute resolution application, and that a lawyer is required to take part in this process.

We’ll guide you through each step, help protect your interests, and work aiming to achieve the best possible outcome for you. If your dispute resolution application is successful at this stage, you won’t pay any legal fees.

You can apply to the Victorian Civil and Administrative Tribunal (VCAT) if you’re not satisfied with the outcome of a TAC review or dispute resolution process.

VCAT reviews can be complex, and the TAC will be represented by a lawyer. Having your own legal support helps to give you the best chance of presenting a strong case and achieving a fair outcome. We can guide you through the process and advocate on your behalf to ensure you meet all the deadlines.
