Glassing victim settles compensation case against Illawarra hotel

Illawarra resident Krystle Kelley has settled a damages claim against the Glasshouse Tavern in Wollongong ending a long running battle to win compensation after she lost sight in one eye and suffered severe scaring following an altercation with another woman in the hotel.
The injuries occurred at the Glasshouse Tavern about midnight on November 3, 2007 when Ms Kelley’s face was cut by a glass after falling to the floor during a fight with another patron.
While the terms of the settlement remain confidential Ms Kelley said she was pleased with the settlement figure and relieved to have the case finished.
“This has been the most difficult experience I have ever been through,” Ms Kelley said.
“The injuries I suffered that night will live with me forever and will have a dramatic impact on the way I live my life.
“I am just glad that the legal side of this is now over and I can move on and start to concentrate on my future rather than constantly looking back at that awful night in the Glasshouse more than four years ago.”
Ms Kelley’s lawyer, Melinda Griffiths from Slater and Gordon in Wollongong, said Krystle’s case against the owners of the Glasshouse Tavern, RDL Investments NSW P/L, had settled just days before the hearing was due to start in the NSW Supreme Court.
“In our case against the Glasshouse we had alleged its owners had failed to take reasonable care and employ adequate security to ensure the safety of its patrons,” Ms Griffiths said.
“We also claimed the owners failed to remove unruly patrons quickly or ensure glasses were not taken on to the dance floor.
“Significantly we also alleged the hotel failed to stop the music and turn on the lights while the fight was in progress and implement a weapons strategy.”
Ms Griffiths said the civil case might at least give Ms Kelley some financial compensation for her injuries and the "drama and trauma she has got to live with for the rest of her life".
