On 6 February 2015, Justice Jessup of the Federal Court of Australia approved the settlement of the Peterson and Reeves Vioxx class action proceedings.
The period for appeal from his judgement passed without any appeal being lodged by any party.
As a result, the settlement went ahead and the Defendant, Merck Sharpe & Dohme Australia Pty Ltd paid the settlement amount and the lead applicants discontinued the proceedings.
The settlement amount has now been distributed amongst all eligible group members and this case has now resolved.
All persons who met the definition of a group member under the
Peterson or Reeves proceeding and who did not opt out of the class
action have had their rights finally dealt with and cannot pursue any
further litigation against the defendants relating to the subject matter
of this proceeding.
