Class actions can give everyday Australians who have been physically or financially harmed the power to hold big corporations and governments to account.

But the Morrison Government has introduced new laws that will drastically limit the ability of Australians to launch a class action.

If passed, these laws will mean individuals who cannot afford to take legal action on their own could have no means of accessing justice in the same way that class actions have long provided.

Over the years, Slater and Gordon has represented hundreds of thousands of Australians in class actions where they have been physically of financially harmed. They include:

  • residents evacuated from a housing estate that was built too close to former landfill sites that leaked dangerous levels of methane gas into homes
  • women infected with Hepatitis C after an anaesthetist injected himself with drugs before using the same syringes on patients undergoing medical procedures
  • shareholders who lost life savings, superannuation and/or inheritance after investing in companies that were doing the wrong thing, and
  • customers sold junk insurance with their credit card or personal loans, even though the bank selling it to them knew that they were ineligible to claim under the terms of, or otherwise highly unlikely to benefit from, the insurance.

Yet many class actions just like these are likely to become unviable to run if the Morrison Government succeeds in bringing in these legislative changes.

We believe Australian laws should always back the rights of average people over deep-pocketed businesses and governments who want to use their size and wealth to get away with breaking the rules.
