It’s important to keep two things in mind when making a claim through your super:

  1. It doesn’t affect your total balance.
Your benefit does not come out of your hard-earned super. The benefit comes from a separate insurance policy that is attached to your superannuation fund.
  2. It doesn’t affect any other claim you may have.
You can claim your Superannuation benefits in addition to other compensation claims. Many people on workers compensation, motor vehicle injury compensation, Comcare or the Centrelink Disability Support Pension can claim as well as people who suffer an unexpected illness that prevents them from working.

You might have an insurance claim through your superannuation if:

  • You were working and your employer was paying compulsory superannuation and you suffer an injury or illness that has prevented you from working for the waiting period
  • You have entered into a private contract of insurance for income protection, disability or trauma insurance

You can also check your level of insurance cover on a recent member statement from your Super Fund, or online.

Firstly, get in touch with our team. We’ll organise a free initial appointment where we’ll understand your situation, and then we’ll investigate the details of your Super Fund membership. If eligible, we will start obtaining evidence to submit your claim. We’ll explain this process in more detail in your no-obligation free initial appointment.

It does not matter how your injury or illness came about - many people on workers compensation, motor vehicle injury compensation, Comcare or the Centrelink benefits can claim, as well as people who suffer an unexpected illness that prevents them from working.

Some people who take advantage of this option would fall below the $6,000 mark in their fund, which may cause their default insurance to be cancelled automatically. Check your Super account online to see if you still have cover, and think carefully about drawing down on your Super for this reason. Learn about early super access.

Each insurance policy definition differs slightly. Typically, you need to prove you've been off work for a period of 3 or 6 consecutive months due to an injury or illness and are permanently unfit for your usual employment for TPD insurance. Shorter waiting periods apply for income protection insurance.

Funds and insurers are making it increasingly difficult for their members to access insurance benefits that they're rightfully entitled to. We’re on your side and here to simplify the claims process for you. Having our expert lawyers represent you mean that you'll have a team who will go above and beyond to ensure your tomorrow starts today.
