Superannuation/TPD, Senior Associate

Ashfield, New South Wales

Tim Gauci was  admitted to the Supreme Court of NSW in 2005 and has worked in asbestos litigation for 7 years.

Tim has acted for many Australians suffering from asbestos related illnesses as well as the family members and dependants of these people who have been deprived of the life and support of a loved one due to these cruel illnesses.

It is a desire to see justice for those affected by asbestos related illnesses, often as a result of a life of hard work or an attempt to better there circumstance through home building or renovation, that motivates Tim in his work.

Tim successfully acted for the late Kevin Phillips, a man who had contracted malignant mesothelioma,  in ensuring that he received his entitlement for damages for the loss of his capacity to provide care to his severely unwell wife in the Dust Diseases decision of K J Phillips v Amaca Pty Ltd [2014] NSWDDT 2.

This decision was appealed by the Defendant to the NSW Court of Appeal where again Tim was successful in ensuring that Mr Phillips retained his proper award of damages.

Tim understands that people who have contracted asbestos related illnesses, through no fault of their own, seek a pathway to compensation that is as quick, efficient and involves the least intrusion in their lives as possible.

I act for people in what is often a very challenging time in their lives. I provide sound advice to them so that they are clear in their mind about the legal processes involved.
