In August 2016, the Bass Coast Shire Council issued Notices of Intention to Acquire land in the Scenic Estate Subdivision, Phillip Island. The Subdivision was created in the 1960s and is on the Northern side of Phillip Island Road, between the road and the coastline.

The subdivision consists of over 300 lots, all of which are vacant and undeveloped. The Council’s intention is to acquire the land for the purposes of creating a conservation reserve.

A number of land owners within the subdivision have contacted us since receiving the Notice of Intention to Acquire. The Council expects to require possession of the land in late November 2016. Based on our considerable experience in compulsory acquisition, Slater and Gordon can explain the process to you and give you advice to protect your interests.

As soon as your property is affected by a compulsory acquisition, it is very important to get legal advice. Our experience has shown that, with the right advice, the amount of compensation obtained can sometimes be considerably more than first thought. It is important to obtain expert advice on valuation and legal issues so that you are fully aware of your entitlements.
Our work is at no cost to you, as the Authority is legally required to pay our costs and we will only seek payment from the Authority – not you.
