What is the difference between a Solicitor and a Conveyancer

Buying or selling a property could be one of the most important decisions you'll make. Being able to trust someone to work with you to achieve the best possible outcome is crucial.

Conveyancing is the process involved in the transfer of title of property between yourself and another party. A conveyance is more complicated than other commercial transactions and it’s crucial to ensure:

  • your legal rights are protected
  • you get title to what you purchase
  • you’re advised on any issues affecting the property.

If you are not fully advised there is a risk that what you buy may not turn out to be a good investment. You are putting a lot of money at risk so it is important to be sure. 

The conveyancing process starts with you making an offer and ends when you get the keys to your property after settlement. There will be a lot of things to consider between these two events.

Is this a good property? Where is the money coming from? Why am I buying (or selling) this property. Are there financial considerations that I need to get advice on? Should I get a building inspection? Or a pest inspection? Or a survey? Will it be a good investment? Am I protected from financial problems in the future? Do I need insurance? A will?

A lawyer may not be able to advise you on all these issues but they will, by virtue of their experience and knowledge, know where the pitfalls are and what you need to do to avoid them.

It’s easy to be confused by the range of services on offer when it comes to a conveyance. Prospective clients often ask us what the difference is between a conveyancer – generally not a lawyer – or a solicitor, who can specialise in conveyancing.

Both conveyancers and solicitors must have undertaken a level of study in Property Law and hold Professional Indemnity Insurance and comply with a Professional Code of Conduct.

Both a conveyancer and a solicitor can help you with a straightforward property purchase or sale but only a solicitor can help you with more complex legal issues that sometimes arise during the process.
