Commercial Litigation

Van MoulisVan Moulis has more than 20 years experience in commercial law matters, dividing this time between complex litigation and corporate advice, Van is one of our most decorated principal lawyers.

He offers specialist legal advice in:

  • Competition law
  • Trade practices and business law
  • Contract disputes
  • Franchising law
  • Employment law with a focus on management non union matters for both employers and employees.

Van Moulis has acted for big corporations and small-medium size enterprises (SMEs) with a balance in favour of SMEs. Most recently, Van successfully represented a family owned SME against proceedings by the ACCC alleging illegal cartel conduct.

Last year, Van was part of the legal team that successfully intervened in a High Court case (Fostif) that has removed one more hurdle in the path of litigation funding for commercial litigation, for instance share holder class actions.

Van is regularly contacted by the press for his expert comments with respect to competition law matters. Recently that has involved a detailed critique of the ACCC's priorities and practices.

He publishes a monthly Legal Watch column for a trade journal that circulates within the oil/convenience store industry in Australia.

Van has also advised lobby groups and most recently, the Australasian Association Convenience Store and the Australian Petrol Agents & Distributors Association regarding changes to the then draft Oil code.

Much of his practice involves seeking compensation for persons wronged in commercial transactions. This includes clients who have been victimised by unconscionable or unfair commercial conduct to corporate breaches adversely affecting shareholders and customers. This fits comfortably with Slater & Gordon's plaintiff law firm history of fighting for just and fair outcomes against corporate bullies.

Van is also very experienced in straight out commercial disputes where one party simply owes the other party money, as distinct from compensation.

Van revels in the challenge of using plain English to demystify the law. He also knows that clients require decisive and clear advice, and honesty in conveying early advice regarding prospects and likely outcomes.

His training as a mediator has encouraged a creative approach to the resolution of commercial matters. Thinking outside the box fits comfortably with Slater & Gordon's progressive approach to the practice of law.
