Commercial Litigation
Kirsten Morrison conducts a broad range of commercial litigation, particularly large-scale commercial disputes.
Current clients include leading edge software companies seeking to enforce their IP rights, shareholders seeking to recover against companies that breach the Corporations Act continuous disclosure rules (in the wake of the Sons of Gwalia decision), shareholders and investors seeking to recover against financial advisers and stockbrokers, the ACCC in its Trade Practices prosecutions and incorporated associations seeking advice on governance.
Kirsten has been involved in a diverse range of advice work and litigation in the past including: advice and litigation for major resource and utility companies involving property, planning, environmental and water law, litigation over defective goods for large manufacturers and agribusiness, advice and litigation for financial institutions and corporate trustees of superannuation funds in response to regulatory investigations, suing property developer Mirvac over “off the plan” contracts at Docklands and representing a correctional facility during a coronial inquest.
Kirsten takes a hands on and flexible approach to litigation. She enjoys working closely with clients to understand their business, quickly identifying the legal issues and then delivering targeted and efficient advice or litigation services to get her clients back to their core business faster.
Past work as a lawyer for major Australian resource companies, financial institutions and manufacturers has given Kirsten the necessary experience to conduct large commercial disputes but also an insight into the issues facing small or medium business, or groups of individuals litigating against large, well-resourced companies.
Kirsten is currently on a secondment from Commercial Litigation to fulfil the role of Acting Corporate Counsel for Slater & Gordon Limited.
