Why you should see us first before you lodge your claim

For most of you this will be the first time you have had anything to do with the military compensation system.

It is therefore important that you have someone with legal training (and not just training provided by the Department of Veterans’ Affairs) to advise you on how to fill in your claim form and what evidence is required to maximise your entitlements to compensation.

  • Your case should be pursued with your interests in mind, not the financial interests of the Commonwealth.
  • The Commission delegates work for the Commonwealth and not for you – they are paid by the Commonwealth, not by you.
  • You need to get your claim right from the beginning.
  • The Commission’s interpretation of the law and your entitlements (that is, whether you should be paid compensation), is often very different to our interpretation of what is intended to be beneficial legislation.
  • Often what the Commission tells you is just plain wrong, which is proved time and again on appeal of its decisions.
  • Hundreds of our clients have obtained a favourable result through using our services when they had been told they were not entitled to anything!

Why you should see us before you accept compensation

In most cases, you will be assessed by a specialist before an offer of compensation is made. Did the Commission obtain an independent medical assessment? Was the specialist one of your choice?

You are entitled to an independent medical examination and opinion before accepting any compensation payment.

Where compensation is being offered for permanent impairment, has the Commission ensured you have received independent legal advice about your rights or the amount of compensation offered?

Has the Commission stated it will make a determination within 21 days whether or not you have received legal advice (after which your rights to pursue a Common Law action may be extinguished)?

You are always entitled to independent legal advice regarding the amount of compensation offered and your Common Law rights before accepting a payment.
