Death Claims & WorkCover 
If you are the partner, spouse or dependent of someone who has died and you think that their work contributed to their death, you may be entitled to WorkCover compensation in the form of both a lump sum payment and an additional pension.
Your own income is not usually taken into account in any dependency assessment.
Compensation is payable where the death is wholly or partly the result of:
- An injury at, or connected with work
- A medical condition caused or made worse by work, including a heart attack, stroke or blood pressure related condition
- The effects of medical treatment for work-related conditions
The dependents, including the spouse and children, of someone who has died as a result of the negligence of some other person, can also sue for common law damages within six years of the date of death.
